What does this kit
contain?
This kit contains all the legal documents you need to
successfully prepare a legally binding living will and
durable power of attorney for both financial and health
care. All the forms are in a fill-in-the-blank format -
both printed and on CD software. Also included are
instructions explaining how to prepare the forms and
then what to do with them when finished.
Living Will & Durable Power of
Attorney
What would you do if you were involved in a serious
accident or had an illness such as Alzheimer's Disease?
With a living will and durable power of attorney, you
can prepare now should you be incapacitated later. All
medical and financial decisions will be made ahead of
time.
Without a living will, it's quite possible the state,
and not the dying person's family, will decide whether
life support systems will be used or not. In many cases,
the state decides against the family wishes because of
the fear of a possible lawsuit.
What is a Living Will and Durable
Power of Attorney?
A living
will is a legal document which is prepared when a
person is mentally competent which will dictate a
person's wish not to be kept alive on life support
machines after they may become brain dead in a serious
accident or from an illness.
A durable power of attorney is a legal document which
authorizes one person to act on behalf of the individual
granting the durable power of attorney to make financial
and/or medical decisions on the individual's behalf
should the individual become incapacitated.
"Durable" means the power of attorney survives
if the individual preparing it becomes incapacitated. If
no durable power of attorney is prepared and the
individual becomes incapacitated, the court will appoint
a guardian or conservator to make the decisions.
